Legea 51/1991 articolul 19,
faptele de '' (...) deţinere, confecţionare sau folosire ilegală de mijloace specifice de interceptare a comunicaţiilor, precum şi de culegere şi transmitere de informaţii cu caracter secret ori confidenţial, prin orice mijloace, īn afara cadrului legal, (...)'', calificāndu-le ca infracţiuni ce se pedepsesc cu īnchisoare de la 2 la 7 ani. Violarea secretului comunicaţiilor este sancţionată şi de articolul 195 din Codul Penal, care prevede că ''deschiderea unei corespondenţe adresate altuia, ori interceptarea unei convorbiri sau comunicări efectuate prin telefon, telegraf sau prin alte mijloace de transmitere la distanţă'' constituie infracţiune.
